Common HIPAA & AI Misconceptions
"ChatGPT Enterprise is HIPAA compliant, so we're fine"
ChatGPT Enterprise can be HIPAA compliant IF you have a BAA with OpenAI, proper access controls, audit logging, and training. Just buying licenses isn't enough. Plus, it only covers OpenAI — not Claude, Gemini, or other shadow AI tools your staff use.
"We told staff not to use AI with PHI, so we're not liable"
A policy without enforcement doesn't protect you. OCR expects technical controls, not honor systems. If staff are using AI despite your ban, you're still liable for the HIPAA violations.
